Waiver

I understand there are inherent risks in participating in a program of strenuous exercise; consequently, I have been examined by a physician of my choice and have obtained his/her approval for my participation in a fitness program. If I choose not to see a physician prior to beginning a fitness program, I do so strictly at my own risk and against recommendation of the Move Well Eat Well trainers.

I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that Move Well Eat Well and its insurers and associates shall not be liable for any damages arising from personal injuries sustained by me in, on, or about the premises as a result of the use of equipment or facilities, regardless of whether such injuries result, in whole or in part, from negligence, without limitation, including Covid-19.

I further agree that Move Well Eat Well shall not be liable or responsible for any injuries, damages, and losses of any type to me resulting from my participation in the fitness program (at the training studio, virtually, outdoors or at a corporate, commercial, residential or other fitness facility), and I fully and forever release and discharge Move Well Eat Well from all claims, actions, judgments and the like which I or my heirs, executors, administrators or assigns may have or claim to have as a result of any injury or other damage which may occur in connection with my participation in the fitness program. This Release shall be binding upon my heirs, executors, administrators, and assigns.

I understand that I am not obligated to perform nor participate in any activity that I do not wish to do, and that it is my right to refuse such participation at any time during my training sessions. I understand that should I feel lightheaded, faint, dizzy, nauseated, or experience pain or discomfort, I am to stop the activity and inform the instructor.

I understand that all training rates are based on 60 minute sessions and should I arrive late, I will not receive the full session.

I understand that food preparation carries with it inherent risks that include but are not limited to health hazards resulting from improper transport, handling and storage.

In consideration of being permitted to participate in any chef demonstration or related event at Move Well Eat Well (Event) where prepared food, cooked, perishable or otherwise are transported, further prepared, and consumed, I, for myself, my heirs, personal representatives or assigns, agents, employees and affiliates, do hereby release, waive, discharge, and covenant not to sue Move Well Eat Well and their affiliates, direct or indirect, officers, employees, and agents from liability from any and all claims resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in any Event.

Participation in any Event carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary, and can include but are not limited to cooking food thoroughly; separating and not cross contaminating foods; chilling or refrigerating food appropriately; cleaning foodstuffs, instruments and hands used in and for food preparation; fire or gas hazards.

I agree to INDEMNIFY AND HOLD HARMLESS Move Well Eat Well, their affiliates, direct or indirect, officers, employees, and agents (the “Indemnitees”) from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in Events, whether brought by me, my company or its agents or employees, or other third parties, and to reimburse the Indemnitees for any such expenses incurred.

​I understand that MOVE WELL EAT WELL photographs and records video of many of THEIR client events/sessions and I provide MOVE WELL EAT WELL the absolute right and permission to use these pictures/images for any lawful promotional, advertising or marketing purpose.

I have read this Waiver of Liability and fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that by attending the Event I am in agreement freely and voluntarily, am over the age of 18, and intend by my purchase of ticket and attendance to be a complete and unconditional release of all liability to the greatest extent allowed by law.
